Terms and conditions for publishing reviews

CASCO GmbH offers the possibility to publish reviews on its website at www.casco-helmets.com.

Publishing a review on the website requires acceptance of and compliance with these Terms for the Publication of Reviews (hereinafter the “Publication Terms”). CASCO GmbH reserves the right to amend them at any time. In such case, we will inform you by updating the date indicated at the end of these Publication Terms and, where appropriate, by additional notifications (e.g., by posting a notice on our website’s homepage or by sending an email).


Article 1 – Purpose of the website’s review feature

1.1 The review feature allows users to submit reviews, tips, comments, suggestions, information and recommendations regarding the products marketed by CASCO GmbH and to assign them a rating from one star (“Poor”) to five stars (“Excellent”).

1.2 CASCO GmbH provides users (hereinafter the “User(s)”) with a space exclusively for storing their reviews in order to publish them on all current and future public communication media of CASCO GmbH, in particular—without limitation—on electronic communication services (notably the 2RIDE Group’s online shops and/or mobile versions) as well as on marketing and/or advertising media (emailings, mailings, online advertising banners, advertising materials in CASCO GmbH stores, etc.) published by CASCO GmbH.


Article 2 – Submission, labels and sorting of reviews

2.1 Any user of CASCO GmbH’s review feature must accept the Publication Terms. CASCO GmbH may require proof of the appropriate consent from underage users and may otherwise refuse to publish a review.

2.2 Users may submit their reviews in the following ways:

- voluntarily and independently by clicking “Submit a review” on the relevant product page. In this case, CASCO GmbH cannot confirm that the user actually purchased or tested the product. These reviews either have no specific label or are marked “spontaneous review”.

- after receiving an email inviting them to submit a review for a product purchased from CASCO GmbH. As these reviews are requested by CASCO GmbH following a purchase, they are marked on the website as “verified buyer”.

2.3 Reviews are displayed by default in chronological order, from newest to oldest. However, users may choose other sorting criteria such as usefulness or rating.


Article 3 – Content of reviews / Users’ responsibility

3.1 A review must include a username, a rating, a title, and a description of at least 50 characters.

3.2 The review feature must not be used to disseminate content that violates good morals, public order, third-party rights, or applicable laws and regulations, including—without limitation—:

- defamatory, insulting, obscene, racist, offensive statements or references to illegal activities in any form;

- any abuse of freedom of expression, in particular systematic or non-objective criticism, as well as disparaging or malicious remarks;

- violent or pornographic content, or content that could undermine human dignity, equality between women and men, or the protection of children and minors;

- statements or content that incite criminal offences, violence, discrimination, or racist hatred;

- identity misuse, in particular the use of a name, email address, or company name;

- the full or partial reproduction of copyrighted content without the corresponding rights, as well as content that constitutes trademark infringement.

3.3 Users agree not to misuse the review feature for propaganda, advertising, solicitation, or proselytizing for professional, commercial, or political purposes (advertisements, spam content, references to other products, commercial offers, or websites).

3.4 Reviews must not, in particular, contain:

- email addresses, URLs, phone numbers, postal addresses, or any other information (first and last name, etc.) enabling the identification of the user or third parties;

- critical comments about other published reviews or their authors;

- comments on the medical effectiveness of the products;

- comments about other products or issues related to orders (delivery problems, etc.);

- comments encouraging purchase from a competitor of CASCO GmbH.

3.5 The content of reviews must comply with these Publication Terms.

3.6 Users also undertake not to disrupt or impair the operation of CASCO GmbH’s review feature.

It is prohibited to attach documents or software to reviews that could damage other users’ devices or enable unauthorized access to other websites.

Users are responsible for taking appropriate measures to protect their devices against viruses or intrusion attempts. “Devices” means, in particular—without limitation—personal computers, PDAs, internet access, software programs and data.

3.7 Users are solely responsible for all content they submit via CASCO GmbH’s review feature.


Article 4 – Moderation and publication of reviews

4.1 Reviews and the associated usernames are systematically moderated using software based on keywords defined by CASCO GmbH and, in certain cases, are additionally reviewed by moderators prior to publication.

CASCO GmbH reserves the right not to publish reviews that do not comply with these Publication Terms. In such case, the user will be informed by email.
CASCO GmbH does not change the content of reviews, but may correct minor spelling or typing errors without altering the meaning of the review. In addition, CASCO GmbH reserves the right to remove at any time any reviews that do not comply with the terms of use.

Once submitted, a review can no longer be modified by the user.

4.2 Reviews are generally published within two to four business days after submission by the user, subject to compliance with the Publication Terms.

The user receives an email confirming publication of their review or, otherwise, a notice of rejection. Any subsequent use of the review in accordance with Article 1.2 will not result in another email notification.

4.3 After a review is published on the website, users may indicate via a dedicated link whether they found the review helpful and may report content they consider inappropriate. CASCO GmbH will review such reports and, where appropriate, remove non-compliant reviews.

4.4 Reviews are published on the website for a maximum period of 10 years. They may be removed by CASCO GmbH before this period ends if they relate to a product that is no longer marketed by CASCO GmbH, or whose characteristics have changed so significantly that the reviews are no longer relevant.


Article 5 – Intellectual property

5.1 CASCO GmbH holds all intellectual property rights to both the structure and content of the website’s review feature (including, but not limited to, texts, logos, images, illustrations, photographs, videos, graphic or audio elements, music, icons, layout, graphic design, software, databases, etc.) or has duly acquired the necessary rights and authorizations. All trademarks and/or logos displayed as part of CASCO GmbH’s review feature are the exclusive property of CASCO GmbH or its service providers, partners or suppliers.

Any use of these elements beyond what is strictly necessary for publishing the user review is prohibited without the prior express written consent of CASCO GmbH or the relevant rights holder.

In general, users undertake not to infringe any intellectual property rights (copyright, related rights, database rights, trademark rights, domain names, etc.) of CASCO GmbH, the companies of the 2ride Group, or third parties. Any unauthorized or improper use may result in appropriate measures or sanctions by CASCO GmbH or the affected third parties.

5.2 By submitting a review on the website, users expressly and free of charge grant CASCO GmbH the right to reproduce, distribute and publicly display their reviews and usernames, in whole or in part, worldwide and for a period of 10 years, on all media.

The media used may include, in particular, graphic and printed media, audiovisual, IT and digital communication media such as CD-ROMs, DVDs, electronic communication services (notably the 2ride Group’s online shops and/or mobile versions) as well as marketing and/or advertising media (emailings, mailings, online advertising banners, advertising materials in CASCO GmbH stores, etc.), as well as any media currently known or developed in the future.

This authorization includes, in particular, CASCO GmbH’s right to use reviews and usernames freely and without charge, reproduce them in whole or in part, delete, adapt, publish, translate, create derivative works, sell and distribute them, in particular for commercial, advertising and marketing purposes.


Article 6 – Personal data

As part of the review feature, CASCO GmbH collects personal data (in particular email address, username, city, age group, gender, skin type, eye color) from users who submit a review on the website.

Only the fields marked with an asterisk in the entry form are mandatory in order to submit a review. Otherwise, the user will not be able to submit their review.

Users are informed that all or part of the personal data collected by CASCO GmbH may be used by CASCO GmbH and, where applicable, by its service providers to publish the reviews on CASCO GmbH’s current and future public communication media, in particular—without limitation—on electronic communication services (notably the 2ride Group’s online shops and/or mobile versions) and/or marketing and advertising media (emailings, mailings, online advertising banners, advertising materials, etc.).

The personal data used for this publication may include, in particular: username, city, age group and gender.

In order to comply with its legal obligations, CASCO GmbH may also collect and store data enabling the identification of any person who has contributed to the creation of online content.
